Oulanya Goes Free as Court Dismisses Rival’s Electoral petition

Court under the jurisdiction of Justice David Matovu has Wednesday morning dismissed the petition challenging the victory of Jacob Oulanyah, the Deputy speaker of parliament as Omoro county Member of Parliament due to lack of vital supporting documents and evidence.

Court under the jurisdiction of Justice David Matovu has Wednesday morning dismissed the petition challenging the victory of Jacob Oulanyah, the Deputy speaker of parliament as Omoro county Member of Parliament due to lack of vital supporting documents and evidence. 

Simon Aketch Toolit, the former Forum for Democratic Change-FDC party candidate and Oulanyah’s rival dragged him to court claiming that results declaration forms were tampered with.
Toolit who has in the recent days been a darling to the media and police for his alleged kidnap accused Oulanyah of using government vehicles during his campaigns and that the Electoral Commission announced the winner as Oulanyah Jacob Collins who never participated in the elections. 


This morning, Justice Matovu explained that; "Court finds that this petition was poorly arranged, lacked vital documents particularly certified DRFs and it was supported by very weak evidence. Therefore the petitioner failed to prove the allegations leveled against the Respondents to the satisfaction of court. I therefore declare that Oulanyah Jacob L'okori was properly and validly elected as the Member of Parliament for Omoro County Constituency with a total of 8218 votes in the election conducted on 18th February 2016.”
The judge also explained that the use of Oulanyah Jacob Collins was a bonafide mistake which does not mean that the result was tempered with since including the name Collins was a human error. 
Justice Matovu therefore dismissed the petition with costs to the petitioner and advised him to appeal to a higher court in case he is dissatisfied with the ruling.
