Gen. Kayihura Granted Bail

The General Military Court Martial sitting in Makindye has this morning granted Bail to the former Inspector General of Police, Gen. Kale Kayihura.

Kayihura was last week charged before the same court with three counts of failure to protect war materials, kidnap and illegal repatriation of Rwandan Nationals and allowing issuance of fire arms to civilians.

His lawyers applied for bail by mouth then, but the court Chairman Lt.Gen. Andrew Gutti asked them to return today August 28th with a written application.

Kayihura’s lawyers led by Peter Kabatsi told Court that their client is sick and needs urgent medical attention. Also, since Gen. Kayihura pleaded not guilty to all the charges, the lawyers believe he is still innocent until proven guilty.

They told a seven member panel that the general is ready to prove his innocence when the trial begins, but he can do this coming from home, considering he is the sole bread winner for the family, has a fixed place of abode in Muyenga, that he has never been convicted another offence, he has substantial sureties, will not miss court and is of advanced age.

The army prosecutor Maj. Raphael Mugisha did not object to the general’s bail, but asked the Court Chairman Lt.Gen. Gutti to set stringent conditions for the Bail. 
Court therefore granted him bail, but restricted Gen. Kayihura from travelling beyond Kampala and Wakiso district.

Gen. Kayihura presented 3 Sureties including; Entebbe Municipality MP Rose Tumusiime, Maj.Gen. James Mugira UPDF, and Maj. Gen. Samuel Kavuma the deputy commander of Land Forces, UPDF.
