Court throws out Otada’s Petition, Okays Amin’s Nomination

Justice Rugadya Atwooki of Masindi High court has dismissed an application by Sam Owori Amooti Otada challenging the nomination of Tampoo Iddi Amin for the Kibanda North County MP National Resistance Movement party primaries.

Justice Rugadya Atwooki of Masindi High court has dismissed an application by Sam Owori Amooti Otada challenging the nomination of Tampoo Iddi Amin for the Kibanda North County MP National Resistance Movement party primaries.

Otada filed an application before Masindi High court last through his lawyer Asuman Nyonyintono of Wagabaza and company advocates claiming that Tampoo was wrongly nominated by the NRM Electoral Commission since the grounds that led to the nullification of his election as Kibanda North County MP were still standing.

The Court of Appeal nullified Tampoo's victory in May this year and ordered fresh elections citing inconsistencies in the names on his academic transcripts and voter's register. However, Tampoo decided to seek re-election prompting Otada to petition court to stop him.

On Monday, Justice Rugadya Atwooki dismissed Otada's application with costs citing lack of evidence by the applicant. He also said Otada's affidavits have a lot of issues that need to be corrected and a lot of time.   

He however, noted that Otada still has some chance to settle the issues and file a fresh application. Commenting on the judgment, Otada conceded that his affidavits had issues and hastened to add that will file afresh application by the end of this week.

He also faulted the NRM Electoral Commission for conducting party primaries in defiance of the court order
