Makindye Chief Magistrate Erias Kakooza has heard this morning, that city Socialite Brian Kirumira alias Bryan White has requested the Director of Public Prosecution-DPP to withdraw attempted murder charges against him after reaching an out of court understanding with his accusers.
On Monday morning, Kirumira’s legal team led by John Bulungu and Rama Omungu told Kakooza that out of court negotiations between the parties were complete and that the two sides had reached an agreement for amicable settlement of the matter.
The lawyers added that they have already submitted papers to the Director of Public Prosecutions Mike Chibita asking for the withdrawal of the charges.
Meanwhile, State Prosecutor Happiness Ainebyoona had no objection to the defence lawyer's request.
Kirumira, aka Bryan White along with his bodyguard, one corporal Thomas Okoth was charged with attempted murder for shooting at his neighbor Victor Bitwire. The prosecution alleges that Kirumira, 32, a businessman and resident of Munyonyo-Buziga, and Okot, 28, a police officer, unlawfully attempted to cause the death of Bitwire on December 13, 2017.
Bitwire was shot in the shoulder and rushed to Nsambya Hospital, from where he was later referred to Kampala International Hospital. However, the circumstances surrounding the shooting have since remained unclear.
During their last appearance in court on March 5, Prosecutor Happiness Ainebyoona told the court that the investigating officer in the case had taken the file for an out of court dialogue between the parties. He added that the two sides needed time to see if the talks were making progress before proceeding with the trial.
Magistrate Kakooza today adjourned the matter to April 24, 2018, to allow the two parties' time to update the court on the feedback from the DPP.
Meanwhile, Kirumira never appeared in court today, with an excuse of being exhausted from Kabaka’s run which happened yesterday morning.
