The State has today withdrawn from one of the two cases faced by former presidential candidate Dr Kizza Besigye.

In the case which was before Magistrate court, Besigye was charged with disobeying lawful orders.

This withdrawal led to the closure of the case file and declaration that Besigye was free of the charges that had been brought against him in the Kasangati court.

However, the DPP still has a right to re-open the same case at any time he wishes to.

The state which was today Friday scheduled to present its fourth witness into the hearing of the case through prosecutor Joseph Kyomuhendo asked Magistrate presiding Grade One Magistrate Freddie Egesa to allow them withdraw from the case claiming they had lost interest in the matter.

However, led by Ernest Kalibbala, the defense lawyers disagreed with the motion for withdrawal of charges on ground that the case had already gone very far and the justice system should be allowed to decide on the matter.

The Charge is drawn April 5th at Mulago roundabout in Kampala when Besigye was involved in a heated exchange with police on his way to the FDC head offices Najjanankumbi, for the then famous weekly party prayers. He was intercepted at Mulago roundabout.

Besigye is said to have disregarded police orders to use their designated route of Yusuf Lule road but insisted on passing through Wandegeya to the city centre.

Police would later arrest Besigye on charges of disrespect of lawful orders.

Currently Besigye is on remand at Luzira Maximum Prison on treason charges
