James Eremye Mawanda the Buganda Road Court chief magistrate is today expected to deliver his ruling on whether or not to subject former Makerere university research fellow Stella Nyanzi to a mental test, and cancel her bail due to subjudice claims by prosecution.

According to Nyanzi, the magistrate is slated to either agree or disagree with her request to halt the processes of the state involuntarily testing her head for soundness of mind according to the Mental Treatment Act.

She further explains that, there are two options: either to stay the mental test but proceed to the criminal case in which she is charged with cyber harassment of the president and offensive communication, or else to stay both the mental test and the hearing of the criminal case.

The magistrate will also decide about the State Prosecutor's complaint about one of Nyanzi’s recent derogatory Facebook posts.

Jonathan Muwaganya told court that Nyanzi’s post was derogatory of him, and that it broke the subjudice rule - a condition of her bail. He thus asked the magistrate to either cancel her bail or else to rebuke her severely.

Mawanda concluded hearing the case last week and deferred ruling to today Tuesday June 20th.

Nyanzi’s lawyer Peter Walubiri told the press that they asked Justice Ereemye to dismiss Muwaganya’s complaint.
